If we can help you, then we will book in an initial consultation, and then get started on your matter. Before starting we will go through the process, and expectations. This ensures we are both in alignment and able to obtain the best possible outcome for you.

Yes. If you wish to change your law firm we can request your files from your previous lawyer on your behalf.

Communication is a core value at Movement Legal. We will keep you updated as your matter progresses through different stages, and will promptly return any emails or calls that you send to us.

No you don't need to come in. We are fully set up to hold any meetings with you via phone, Whatsapp, Zoom or Google Meet.

During your initial consultation, you will be asked questions about the 3 areas of the relationship – assets, the nature of the relationship, and children, as well as what you hope to achieve to settle your matter.

This will enable your lawyer to gain a better understanding of your matter and then be able to provide you strategic legal advice and a course of action.

If you are concerned about someone finding out about your appointment or matter with us, we can tailor a plan to assist you.

You do not need to wait until the divorce has been formalised. As soon as you have separated from your ex-partner, you can begin the process of a property settlement.

Assets that have been acquired during the period of separation will be included in the “asset pool” to be divided between the parties. This continues until the date of settlement.

You are best advised to engage a family law lawyer to help you obtain an optimal outcome from this process.

 

If the divorce proceeding is one-sided and only one person in the couple applies, then you or your representative will be required to attend Court.

You will also need to go to court if children are involved.

The cost of divorce depends on whether there is any dispute to resolve, whether you will need lawyers to attend a court hearing, and the filing charge of the FCFOA (Federal Circuit and Family Court of Australia).

After divorce you will need to go through a 'property settlement', as the divorce process itself doesn't concern property and assets.

This will need to happen within 12 months of the divorce being finalised (or 2 years after the end of a defacto relationship), provided you and your ex-spouse can't reach an amicable agreement outside of the court system.

Children have a right to spend time with both of their parents.
